The Supreme Court of India on September 6, 2018, decriminalised Section 377 making gay sex legal. The SC in its verdict mentioned that consensual sex between adults in private space, which is not harmful to women or children, cannot be denied as it is a matter of individual choice. The apex court partially strikes down Section 377.

"Section 377 results in discrimination and is violative of constitutional principles. Consensual sex between adult homosexuals in private is not an offence", said Supreme Court in its verdict.
