Man gets life term for killing sodomy victim
Ludhiana: A district court has awarded life imprisonment to a man found guilty of murder following unnatural sex. Additional sessions judge/fast track court Sandeep Singh Bajwa imposed a fine of Rs 40,000 on the convict, with a provision for two years of additional rigorous imprisonment if the fine remains unpaid.
On Oct 21, 2018, Sadar Police registered a case under IPC sections 302 (murder) and 377 (unnatural sex). The victim's brother, who filed the complaint, worked as a labourer alongside his elder brother, who slept at a village resident's motor. The complainant stated that his brother had previously disclosed that the assaulter and his brother from the village were extorting money and coercing him into physical relations. On Oct 20, 2018, the victim's employer reported his absence from work after lunch.
Upon visiting the motor, the complainant discovered his brother's body with a sheet around his neck.
Following investigation, police submitted the chargesheet. During proceedings, the accused claimed false implication.
The court noted the accused's failure to address the death allegations or present evidence challenging the murder charges. The accused neither weakened the accusations nor approached authorities regarding alleged false implication. The court concluded that the accused provided no explanation for the circumstances surrounding the victim's death, thereby establishing guilt.
The court imposed rigorous life imprisonment under section 302 and ten years rigorous imprisonment under section 377 of IPC, with both sentences to run concurrently.
