According to the lawsuit acquired by PEOPLE, Kelley is suing the Blindspot alum, 47, for alleged assault, battery, intentional infliction of mental distress, false detention, and domestic abuse, among other claims.
The couple, who met in 2016 and began a love relationship two years later, will start living together in April 2022, according to the application. Kelley says that after their cohabitation, Stapleton "actively used threats of violence and intimidation to subjugate [her] will to his own, and to enable him to accomplish the wrongful acts alleged hereinafter."
In the lawsuit, Kelley alleged that Stapleton, who played Kurt Weller on the NBC series from 2015 to 2020, put her "in fear of physical harm, particularly if she did not give in to his demands for sex and other demands, through statements made to her in an angry tone such as (1) 'It's survival of the fittest.'" I could murder you, but I won't.' (2) 'I wouldn't keep a gun in the house. First and foremost, if I needed to murder you, I wouldn't need a gun; I'd just use my hands, and (3) 'I have to train you exactly like I train my dog.'"
Kelley described many claimed abuse episodes in her lawsuit, including one at the Viceroy Hotel in Santa Monica, California. On June 27, 2022, she claimed that Stapleton became "enraged" because she was "unwilling" to participate in sexual intercourse while staying in a hotel.
"In his rage, and without regard for her safety, wellbeing or feelings, the defendant grabbed her mobile and struck her repeatedly on the arm with it while he trapped her on the bed," she told me. "She managed to get herself up and rushed to the other bedroom. [Stapleton] followed her and entered the restroom before she had time to lock the door. Once inside the bathroom, [Stapleton] pinned her by her arms, shoulders and neck to a glass shower door."
Kelley stated that in the bathroom, he "continued to use physical force and the infliction of pain until she returned, under compulsion, to the bedroom." She then reportedly "submitted herself, under compulsion, to sexual intercourse with him."
In another alleged incident in early 2023, Kelley claimed that Stapleton bought "two heavy pellet-guns" and used one of them to shoot a house guest in the leg on March 4, 2023. She said: "His action on that day caused [her] to be subjected to domination by [Stapleton], and to subsequent unwanted touching and contact."
On December 5, 2023, after an alleged altercation at a restaurant and inviting a friend over against his preferences, Stapleton allegedly "physically attacked" her, injuring her with a cut on the shoulder, facial bruising, swelling, and a deep laceration on her cheek. Several days after the alleged event, Stapleton allegedly told her, "You should think of your actions every time you look at your scar."
Kelley said that Stapleton's alleged conduct will continue to cause her "personal injury, pain and suffering, anguish, and severe emotional distress."
In addition to general and compensatory damages, she seeks punitive or exemplary damages and a jury trial.
