Bhopal: The MP high court stated that a person's name must be on the BPL list by the last day for filing an application for a post; otherwise, they would not be entitled to the benefits given to a BPL candidate. The court, while dismissing a petition, said that the petitioner failed to prove that her name was on the BPL list when she applied for the job of anganwadi worker, and therefore, she is not entitled to the 10 extra marks given to BPL candidates.
Laxmi Shukla from Rewa district, in her petition, said that the Women & Child Development Officer advertised vacancies for anganwadi workers on Oct 16, 2016. The last date for applying for the post was Oct 27, 2016. For Anganwadi Centre Gauri, she applied, as did the respondent in the petition, Shashikala Kushwaha. In the result, she obtained the 6th position, while Shashikala came first. Within seven days after the result was declared, she submitted an objection because she was not given 10 additional marks, which should have been given to her as she comes from a BPL family.
In the revised list issued on April 24, 2017, she was at the top and was given a posting on April 27. An appeal against her appointment was filed before the Divisional Commissioner Rewa. The Commissioner Rewa cancelled the result and ordered the deduction of the 10 additional marks given to her.
During the hearing of the petition, the bench of Justice Vinay Saraf found that the petitioner's name appeared on the BPL card of her sister-in-law. Her name was included in her sister-in-law's Samagra ID on Feb 27, 2017. The petitioner couldn't provide any evidence to show that her name was on the BPL list when she applied for the post. After hearing all the sides, the court dismissed the petition.
