Congress leader Rahul Gandhi intensified his criticism of Prime Minister Narendra Modi, alleging that the government is shielding Gautam Adani from investigation and arrest despite serious charges filed against him in the United States. "As Leader of Opposition, it is my responsibility to raise this issue. The prime minister is hundred percent protecting this person," said Gandhi, referring to the recent indictment of Adani by US prosecutors over a $250 million bribery scheme.

Gandhi demanded immediate action, stating, "We demand a JPC, but we want that Adani should be arrested immediately. However, we know and want to show this to the country that Adani will not be arrested because the prime minister is his protector." He accused the BJP government of enabling Adani's alleged misconduct, declaring, "This person has obtained India's assets through corruption. This person supports the BJP... these things are established."

Gautam Adani, his nephew Sagar Adani, and former Adani Green Energy CEO Vneet Jaain were charged in the Eastern District of New York with offering $250 million in bribes to Indian officials to secure lucrative solar energy contracts. US prosecutors claimed these deals were misrepresented to raise over $3 billion from American financial institutions.

Gandhi highlighted the gravity of the accusations, saying, "It is now pretty clear and established in America that Mr Adani has broken both American law and Indian law. He has been indicted in the United States, and I am wondering why Mr Adani is still running around a free man in this country." He also alleged the involvement of SEBI chairperson Madhabi Puri Buch, stating, "Adani should be arrested immediately, and his 'protector' Madhabi Puri Buch should be probed."

This controversy comes as Adani Group stocks faced significant losses, with a combined market valuation erosion of ₹2.45 lakh crore on Thursday. Key group companies like Adani Enterprises, Adani Green Energy, and Adani Ports saw declines ranging from 18% to 23%. Gandhi criticised the government’s inaction, saying, "We have been raising this again and again... it is a vindication of what we have been saying. The prime minister is protecting Mr Adani and the prime minister is involved in corruption with Mr Adani."

The indictment has reignited scrutiny of the Adani Group, already under pressure from earlier allegations of stock manipulation by Hindenburg Research. While the US has issued arrest warrants for Gautam and Sagar Adani, the prospect of their extradition remains uncertain. Gandhi vowed to continue raising the issue, stating, "As Leader of Opposition, I will raise this issue in Lok Sabha; our demand for JPC stands."

Adani misled investors with false info, says DoJ

The US DoJ’s indictment paper said Adani Group had misled investors by giving false statements to Indian stock exchanges — NSE & BSE. Under Sebi’s rules for listing and disclosures of corporate events, there are various kinds of penalties for violations of such rules (named Listing Obligation & Disclosure Requirements, or LODR).

In its indictment paper, the US DoJ said that in March 2024, a news article was published that said the US govt was probing Gautam Adani and his group over potential bribery. At that time, Gautam Adani and his nephew Sagar Adani were aware of the FBI investigation as well as the grand jury investigation. This was after a subpoena was issued to the group’s top executives. The US investigators also had the right to search electronic devices of Sagar Adani that allowed them seizure of evidence of criminality by Gautam Adani and others, the US DoJ paper said.

Despite their knowledge of the US govt investigations, the group gave a statement to the news article saying it was “not aware of any investigation against” its chairman Gautam Adani. In the same article, it also said that the group always maintained “the highest standards of governance” and it was “fully compliant with anti-corruption and anti-bribery laws in India and other coun tries,” the DoJ paper noted.

Green arms scrap $600mn bond offer

A host of subsidiaries of Adani Green Energy that were on course to raise $600 million through foreign bonds withdrew the offer on Thursday after the US Department of Justice indicted group chairman Gautam Adani and six related entities of alleged bribery charges. The bond offering had opened on Wednesday and was subscribed about three times the amount being raised, Adani group sources told TOI.

The company informed exchanges that after the US DOJ issued a criminal indictment and brought a civil complaint against some of its board members, its subsidiaries decided “not to proceed with the proposed dollar de nominated bond offerings”.

This was the second scrapping of a bond offering by Adani Green in as many months. In Oct, the company had intimated exchanges about a bond offering but didn’t proceed with it citing unfavourable market conditions due to the US presidential election on Nov 5.

After the DOJ indictment, global ratings major Moody’s Ratings said that the development was a credit negative for the group. “The indictment of Adani Group’s chairman and other senior officials on bribery charges is credit negative for the group’s companies,” Moody’s said.

After the charges were made public early on Thursday, bonds of the group’s companies slid, media reports said.

Gandhi demanded a Joint Parliamentary Committee (JPC) probe and Adani’s immediate arrest, asserting, "We know and want to show this to the country that Adani will not be arrested because the prime minister is his protector."

Adani, along with his nephew Sagar Adani and former Adani Green Energy CEO Vneet Jaain, has been charged by US prosecutors for offering bribes to Indian officials to secure solar energy contracts. Meanwhile, Adani Group stocks suffered a ₹2.45 lakh crore erosion in market valuation.

Gandhi criticised the BJP government’s alleged complicity, saying, "The prime minister is involved in corruption with Mr Adani," and pledged to continue raising the issue in Parliament.
